Two Important Traffic Laws to be Debated by the Georgia Legislature
January 18th, 2010The Georgia Legislature, which convened last week, is expected to consider two laws that will impact drivers across the state. Sen. Don Thomas of Dalton has been trying for many years to get a law passed that will require adults who drive a truck to wear a seat belt. Georgia is the only state that provides such an exemption.
Rep. Amos Anderson of Dahlonega is introducing a bill that would prohibit texting while driving. This bill has been passed in other states, including Tennessee. If the bill passes, drivers could face fines of up to $300.
The state house is always full of surprises. With lawmakers facing problems with declining revenues and request for more services, it will be interesting to see how much attention will be given to traffic laws.
DUI Roadblocks
October 28th, 2009With so many parties expected for Halloween weekend, many law enforcement agencies will have roadblocks set up. If you have had just a little too much to drink, you may be more scared at the roadblock than you were at Uncle Joe’s spooky bash. Here are some tips for how you should act if you are stopped at a DUI roadblock:
1. Roll down your window just enough to be able to speak to the officer. If he asks for you license and registration, you should give them to him. However, you are not obligated to do so, contrary to popular belief.
2. Most people immediately try to have a conversation with the officer or justify why they have been drinking. You don’t have to say anything to the officer. Politely tell him or her that you refuse to answer questions unless you have talked with your attorney.
2. You have the right to refuse to let the officer search your vehicle unless he or she can give probable cause.
3. You can refuse to take any field sobriety tests.
4. If the officer decides to arrest you, let him or her know that you refuse to have your car impounded. Tell the officer you will make arrangements for your vehicle.
If you are driving drunk, you may still be cited. But remember that loose lips can sink ships or in this case, get you a high fine, your license suspended and a possible jail term. If you are arrested this Halloween weekend, give me a call so I can help.

To Breathe or not to Breathe
August 4th, 2009When you are stopped by a police officer on suspicion of DUI, you may be asked to take a breathalyzer test. You may think if you refuse, you can beat the charge. This is not always the case.
In Georgia, if you refuse to breath into the breathalyzer, it can be considered an admission of guilt—even if you had nothing to drink before you were stopped. A judge or a jury will question your decision. Don’t get me wrong, you have the right to refuse the test. Just know that there could be other consequences.
